Legal Question in Civil Litigation in New York

My 16 year old autistic son has money in a court ordered cd from a car accident 5 years ago. I was told it will be released when he is 18. The issue is that he is unable to handle his own affairs since he is unable to read or write with comprehension. When he turns 18 next year, how can I have this money released on his behalf?

You need to petition the court to be appointed as his legal guardian not only with respect to the bank account but also his other affairs. The court may appoint some one else as a legal guardian. You have to periodically advise the court of the expenditures on his behalf with bonafide receipts.
