Legal Question in Civil Litigation in New York

legal action for repayment

My girlfriend's ex boyfriend from Idaho owes her over $3500. She has receipts from online money transfers, credit card statements and receipts to prove most of the $3500 amount. He keeps telling her that he will pay her back but never does. Is there any legal way to get the money he owes her without taking him to court?

No. There is no legal way of getting your money without going to court. In New York, Small Claims Court handles matters under $5,000.00. However, I can't tell from the facts if New York has jurisdiction in your matter.

Believe it or not, the biggest problem is not obtaining a judgment but collecting it. These days, most people don't care about having a judgment on their record. It only affects their credit, which is probably in bad shape to begin with.

Asset and bank searches and the legal fees involved may well cost you more than what you're owed. Moreover, you're looking at spending hours upon hours of your precious time.

$3,500 for most people is not a small amount of money. Unfortunately, you're better off putting it behind you and being very careful about who you lend money to in the future.

I hope this was helpful.
