Legal Question in Civil Litigation in New York

Hi! I have a question - We have a huge, old tree in our yard, one limb of which overhangs our neighbors' yard. They hung a swing on that limb for their children (with our permission). However, with the rough weather this past winter, it no longer appears to us that that limb can support that swing safely. Our neighbors, however, are still using it. My question is, if that limb should fall and injure one of the children, would we be liable?

Yes, you could be liable. You should talk to your neighbors and remove the swing.
