Legal Question in Immigration Law in New York

I came to US at 2010 with J-1 visa, tried to change it to B-2, got denial. Then appealed with lawyer at 2011 and when I check my status online on USCIS site - it says still under review cause of non-delivery. I want to get green card through marriage. My question is if I fill and send with other documents I-131 form, how soon I can leave US and for how long and do I have to wait for the interview then leave the country or I can leave it after interview only?
