Legal Question in Immigration Law in New York

Affidavit of Support

I am a US citizen medical student who married a Canadian. We are applying for permanant resident status for him. Can my medical student loans (I receive $19-20K/year for living expense out of the total amount borrowed) be used as my income for the affidavit of support (I-864)? Thank you in advance for any information you can offer.

Re: Affidavit of Support

A loan itself is not an asset, therefore you will not be able to use this as income for the I-864. However, you can use someone else's income as a joint sponsor, if their income meets the poverty level for your household size and they are willing to sign the commitment statement on the 1-864.

Another option for you is to use the value of any assets you own to meet the income requirements. Assets such as bank statements, real property and stocks are all assets that can be used to meet the income requirements of the I-864.
