Legal Question in Immigration Law in New York

Banned from the USA

Hi, I was speaking to my friend, who I believe needs some advice. He hasl egally travelled to the US many times without any problems, over the years and has not been in trouble with the law on his visits

Over five years ago he petioned for family based immigration to the US via consular process.(his parents live in the US)

When he got to the US embassy interview, he was denied because of his criminal background which happend over 25 years ago and has not been in trouble since.

Even though his mother had a US immigration lawyer, she did not disclose this information.

Since then my friend beleives that he has been banned from entering the US and needs a vistors visa

With the little background given, can someone help with these questons.

1) As a UK citizen does my friend need to apply for a visitors visa to enter the US

2)Can his parents petiton for him again if he was in the US

3) Has he been banned from the US, since his immigration petition via consular process was denied

4) Does my friend need to produce a criminal background report in order to get a visitors visa

5)What would happend if he just legally entered the US without a visa

He wants to visit his family soon. I hope someone responds.

I would advise your friend to consult with an attorney to discuss his options in detail and have the attorney review all prior applications.
