Legal Question in Immigration Law in New York

I am a US citizen. My parents arrived in the US on visitor visas in March 2011. How soon can I file I-130 and I-485 for them? Is there a recommended waiting period?

There is a recommended waiting period of 60 days after entry to the U.S. before I-130/I-485 are filed. As long as the sponsorship paperwork is properly filed prior to I-94 expiration, your parents can continue to remain legally in the U.S. We have additional information here: www.h1b1.com/sponsor.htm

You must be 21 years of age to file for your parents as your immediate relatives. Whether your parents will be granted their green card will depend on what they told the Immigration Officers at the airport and what their intent of their visit was. So long as they were truthful when questioned at the airport and had no preconceived intent of permanently remaining in the U.S., they should be able to file for their green cards.
