Legal Question in Immigration Law in New York

What is the fastest way for my ladyfriend to obtain a visa to come to the USA?

Hello,

What is the quickest way to get my girlfriend(and her 1 yr old son) whom Ive never met in person to the USA? Most probably we will marry after she is here a while. Will that automatically grant her permanant status? I am not able to have her apply for a fiance visa as I cannot go to visit her at this time to prove we have met. What visa would be the quickest for her to get here and how shall we go about doing it? She was told to just get a passport and for me to send her a letter of invitation and that would be enough, but is that the fastest way? I am a US citizen and she resides in Uganda. Thank you anyone who can help.

Re: What is the fastest way for my ladyfriend to obtain a visa to come to the US

An alien that is outside the U.S. that has the intent to immigrate to the U.S. must apply for an immigrant visa or a K visa.

In order for a person to obtain an immigrant visa they must be petitioned by a USC or LPR immediate relative, inter alia. A husband is an immediate relative.

A person that applies for a K-3 visa must be a spouse of a USC.

A person that applied for a K-1 visa must be the fiance of a USC that plans to marry the USC within 90 of entry. If the marriage does not take place with the specific USC the alien is deportable.

Every visa described has additional requirements to the general description provided.
