Legal Question in Immigration Law in New York

Fiance Visa

I made arrangements for someone to file my fiance visa for me back in April of 2008. As it turns out I dont know if the person has ever filed the visa. He was a friend who had experience in these matters. I paid him 600 dollars. He was not an attorney and didnt claim them to be, I am not holding him liable. I just want to know if our papers were filed. He said the only way he can tell if Uscis got the papers was if the money order cleared or not. The reason is that when he asked me if i wanted a receipt back in May I said No, your my friend I trust you(big mistake on my part,I know) Question is: Is there any way to tell if they were filed ,such as giving them my name? The man who filed has given me wishwashy answers and has suggested that I marry the girl first now in the philippines which leads me to beleive that perhaps he never filed the papers. I have been to see Rose last summer and this summer. 07 and 08, and we talk everyday, so there is no lack of communication on our part. He has copies of all my papers I dont have anything Im afraid to take any action in fear I will lose any papers I need to file again. What should I do? What can I do? Thank You, Peter Cooke,Long Island,NY

Re: Fiance Visa

It sounds like he didn't file your application. Does he have a copy of the cleared check that was paid to USCIS for the filing fee? Does he have a copy of the USCIS receipt? I anticipate the answers to those questions are no. You should seek the assistance of an attorney and properly file for the fiance visa. If you need assistance please contact me. Thanks.
