Legal Question in Immigration Law in New York

immigration and income

Dear Attorney, i have a brief question - i am waiting for my conditional residence removed through marriage and have to wait another 4-5 months, is it true you get a paper from

them that says ''prove to us that you can support your entire household

on just your income,'' that is 125% of the poverty guideline for the

amount of people in your household.

My wife is in law school and we took loans, and I had all my

income last year overseas, so our tax return for 2008 is very, very

small.

I can show that I get enough money transfer

from overseas and my bank account average statement is well above 125%

poverty line, it's just we did not supply that info to them.

Do you think that could present a problem in any way?

thanks,

Ivan

Re: immigration and income

I think you should consult with an immigration attorney.

Since you are a perment resident, you are taxable in the U.S. on your worldwide income, regardless of whether or not it was earned overseas. Therefore, your U.S. tax returns should be reflecting this income.

Please feel free to contact me for more information. Thanks.
