Legal Question in Immigration Law in New York

Should my sis come back?

Hi!My younger sister went back to India last year because of her illegal status. She had been a brilliant poet. In 2001, she submitted her poetry collection to many publishing companies.Few replied back but cause the royality was too low,my sister didn't accept the offer. At that time, she was not over stay here. But last year, she returned back to india because she didn't want to get deported. Now after almost 3 yeras, a major publishing company has contacted us,accepting to publish my sister's poetry collections as a book. They are paying a high advance and good royality too. My sister always wanted to be accepted by such a big company that's why she rejected the others.Would you please tell me if my sister can come back here again? On what visa? will her previous record creat any trouble for her? Can she come here because her book is being published here and she wants to promote it? It would be very kind if you reply me.Thank you.

Re: Should my sis come back?

Congratulations! This is wonderful. Your should be very proud of your sister. Please give me her name that I might look for her work.

Regarding your question; she will be very welcome in the US. Her previous record will support her because, rather than over-stay, she returned to India. This is a plus. She is eligible for a visa to pursue her business opportunity (book tour/promotions/sign contracts, etc) and also a green card/work permit/resident status for 'exceptional talent' (the exceptional talent is more difficult). But she is also eligible for a green card if sponsored by the publisher.

There are several options here, both temporary and permanent.
