Legal Question in Immigration Law in New York

My UK passport was stolen while in the US, I have reported to the British Consulate who put a stop on it. I want to get a new one, they told me I would have to send all the paper work.to Washington DC, where the British Embassy is. In the passport that was stolen it has my i94w, plus I am an overstayer. At the moment I use my old expired passport as ID, but what i want to know, do i need to have a return ticket, green card or any immigration papers, so send to DC before I can get my new passport.

No, you don't have to send any immigration papers to Washington. You are dealing with two different government entities. All you need is to proof to the British Embassy that you are, what you say you are. That is, to proof that you are a British citizen. A birth certificate will do.
