Legal Question in Immigration Law in New York

I have my undergraduate in finance and an MBA from US. I filed my h1b for "Tax Preparer" from an accounting firm. Now I received RFE stating that the job description provided is not specialty occupation. Now my potential employer wants to withdraw the application and refile under Manager. Can I do that and what are the consequences.
