Legal Question in Insurance Law in New York

Car Accident

On 12/26 my wife was on her way to pick up our grandson in our minivan when she was hit by an elderly man driving a 4 door chevy cavalier. He ran a stop sign and hit her in the front fender pushing the vehicle into the curb. He was ticketed and deemed at fault. Both his vehicle and ours were deemed total losses. My wife sustained two broken ribs and has been out of work since then. She has multiple ongoing health issues that make her a slow healer. My insurance company is picking-up the medical portion so far. I have been trying to deal with my insurance company and I believe that they are giving me somewhat less than what the car is worth. Furthermore I had just bought the vehicle in the spring and am now in a negative equity position. My insurance company is bieng very rigid. Furthermore, the other insurance company admitted

liability while on the phone with my wife. My question is: How do I handle this without retaliation from my insurance company??

You need to retain a lawyer immediately. Your insurance company is probably not giving you what you deserve, nor will they unless you have a lawyer on your side. You may also be entitled to additional compensation for your lost work, pain and suffering, etc. Do not do this alone. The insurance company is being advised by attorneys. I cannot stress this enough. Get a competent lawyer on your side and get what you deserve.
