Legal Question in Insurance Law in New York

student accident insurance

can a public school in new york state hold back student accident insurance from a student who was assulted on school property during school hours? the schools claiming it was an altercation.and they have a policy that altercations are not covered, yet the accident insurance company covers altercation. their is no written policy from the school stating that student involved in altercation are not covered. the insurance company says its their decision, and that she should have and is still elidigiable for coverage, the school refused for 5 years to give us the form, we have over &30,000 in unpaid medical bills and my daughter did not have a surgery that would have been covered. can they do this???

Yes they do. The insurance does not cover intentional acts. This is an intentional act. Moreover, I am not sure if your have standing to contest this claim unless you were the insured *policy holder.
