Legal Question in Landlord & Tenant Law in New York

3 Day Notice

I recently sent a 3 Day Notice for non-payment of rentaccording to state law in New York . It was sent certified with return receipt requested. I was notified that a notice was left in his mailbox. He did not pick it up. Meanwhile, he sent the rent which was 19 days late on the 19th; the same day he recieved the notice in the mail. The lease states that late payments are grounds for Default on the lease. Can I send a certified notice that the lease is terminated and fille to evict ? He has been late four months in a row and I have been late in paying my bills because of him.

This is a question that should be addressed to a NY lawyer since it apears from the question that the property is in NY and you were following NY law.
