arrears of rent

tenant in apt two only paid half the rent for dec and tenant in apt one hasnt paid rent since sept. i want to go into court on non payment of rent eviction. should i except jan lst rent if offered to me would this stop me from going into court for back payments if judge awards me my owed rent and i cant collect how do i garnishee or use city marshall for collection do i have to ask judge for this at time of appearance in court if i accept jan rent does that make my 30 day wait null and void for non payment eviction one tenant has rented a room to aunt within apt its ok with me but is that legal
