Legal Question in Landlord & Tenant Law in New York

Lease Termination

We have notified our landlord of not renewing lease. She has agreed to extend lease by one month at current amount, but had a lawyer draw up a paper stating any day after that she is going to charge us $100 a day. Is this legal? We are not going to agree to this naturally. We are trying to buy a house and are not sure of an exact move out date? Please help??

There is nothing inherently illegal about this clause. You are free to negotiate it, however neither you or the landlord is obligated to accomodate the other party.
