Legal Question in Landlord & Tenant Law in New York

Rent Demand

I received a Rent Demand letter

requiring me to pay rent within five

days or give up possession of the

premises to the landlord. If I fail to

pay or give up the premises, the

landlord will ''commence proceedings

against me to recover the premises.''

I am at fault - I owe 3 months back

rent. I also have 7 month remaining

on my lease. I can't pay, and I will

leave, knowing that I am breaking

my lease and that the large

management company (they own 25

buildings in NYC) will pursue me for

the back rent and most likely the

remainder of the lease. My question:

How do I ''officially'' give up the

premises? I will leave and want them

to know that I am complying with

their request to give up the premises

and will be out of the apartment

before another month starts. (I'd also

prefer to avoid any ''confrontation''

with them.) I received the Rent

Demand over 10 days ago and have

heard nothing from them since. The

superintendent of my building will

not return my phone calls (I've left at

least 15 messages for him since

receiving the letter). Again: How do I

''officially'' give up the premises?

Thank you.

Re: Rent Demand

Q. How do I ''officially'' give up the premises?

A. Deliver the keys to the super. Make sure that the super signs an acknowledgment that you delivered the keys.

Mike.
