Legal Question in Landlord & Tenant Law in New York

I'm subleasing a co-op from a man who passed away a few months ago i just found out that the mans widow who i have been sending the checks to has been cashing the checks and not paying their portion to the co-op i found this information out by her husband's nephew who says now to send him the checks but i'm not sure who to send them too... what should or can i do?

You should ask either the widow or the nephew for a copy of the "Testamentary Letters" or "Letters of Administration" issued by the Surrogate's Court. In a nutshell, this is a document that allows an individual to administer the estate of a decedent.

If you do not receive a copy of either document, you may send the check to either; however, the check should be paid to the order of "The Estate of [name of prior landlord]."
