Legal Question in Legal Ethics in New York

Health Insurance ''run around''

My husband was eligable for health insurance through

is employer after 6 months but his employer told him 1

year. He waited for the 1 year and submitted his

application to his employer. Then the employer told

him that the HMO company would not accept new

enrollment untill January. We checked with the HMO

provider and they told us as soon as the employer

submits the application to them they will process it.

After confronting the employer about what the HMO said

he then told my husband that is because he goes

through the Chamber of Comerce too. Now my husband has

been employed with thhis company for well over a year

and still no healt coverage. I recently got very ill

and was in the hospital. I will be having surgery this

month and the medical bills are sky high. The bottom

line is that we should have been covered by the health

insurance by now and instead we are paying outrageous

bills that we cannot afford. I am wondering if we have

a case agai

Re: Health Insurance ''run around''

If your husband was eligible for coverage after 6 months and the employer caused a delay in coverage which adversely affected him or you, you may well have a cause of action against the employer.

Check with a member of the American Trial Lawyers Association in your town and find out what your rights are. Initial consultations/case evaulations are usually done at no cost - ask first.
