Legal Question in Medical Malpractice in New York

My dad underwent triple by-pass, heart valve replacement. the surgery went well however, he contracted septice from day 3 and ultimately passed away 20 days later. during this time he was "retubated" for a 2nd time. Cause of death was "CHF" with septice (HA MRSA) and respiratory heart failure as contributing factors. I know that his death could have been avoided. Do I have any grounds for a suit?

The classic defense to a medical malpractice case like yours is the accepted risk of infection with surgery. It would take a physician to review the entire chart thoroughly with an eye toward identifying any departure by anyone involved with your father's medical care which caused, or directly led to, the infection. You may have a cause of action but a detailed analysis of the medical record will determine this.
