Legal Question in Medical Malpractice in New York

Liability of plaintiff

Is the plaintiff in a medical malpractice suit, in which his or her attorney takes the case on a contingency fee basis, liable for any costs (e.g. court costs, opposing attorney's fees) if the suit is not successful?

Re: Liability of plaintiff

Your retainer agreement must, by law, provide that the client is responsible for all expenses associated with the case;...usually this is at the conclusion of the matter.

Adverse attorney fees are not part of this.
