Legal Question in Medical Malpractice in New York

My 67 year old father went into the hospital with a headache, was quarantined and told he had meningitis, he died 4 days late and autopsy shows no signs of meningitis. I believe the hospital treated him incorrectly and that is why he died. Was he too old to file a malpractice suit against St Johns Hospital?? Please help

The answer to this question is that he was not too old to not mean anything, and a malpractice case can be filed within 2 1/2 years of the date that the malpractice occurred.

You must have three (3) items established

1. Was their negligence. - What did the autopsy and death certificate say that he died of? Could what he died of be treatable.

2. What where the injuries -

3. The relationship of the injuries and the negligence.

If he had cancer and would have died within a short period of time anyway, then there would not have been any neglignece.

A lawyer would have to review the autopsy report, and the entire medical record to find if these elements can be established.
