Legal Question in Medical Malpractice in New York

orthadontist braces problem

My friend has received a pair of braces from their orthodontist and the metal wire inside them was to short and would continually come out of place and hurt their cheek even after one appointment to fix it, and no, they did not chew any gum or candy to break it. one day they were eating and the piece broke off and they swallowed it and have now been having intense stomach pain. they asked me to search to see if their was anyway they could sue their doctor or get a settlement from them. thanks for your time.
