Legal Question in Medical Malpractice in New York

suing a dentist

I went to a dental school for a root canal. the student drilled too far into me and created a hole in my tooth. Now i may have to have it removed. At this point there is a 50 50 chance of saving my tooth after oral surgery possible having an extraction. can i possibly sue for anything?

You don't say whether you signed any sort of consent form prior to having the root canal. If so, you need to look carefully at the language. Moreover, it would take another dentist with experience in root canal to say the student erred. Yours may have been an especially difficult job. If the tooth is ultimately saved through oral surgery your damages would be minimal. Lots of questions here. Good luck. Best, M. E. Zuller
