Legal Question in Personal Injury in New York

On 2/11/10 my boyfriend and I got into a serious car accident. Our light was green and we were going through the intersection and a woman ran the red light and hit my car and hit a bus. (The police report says she ran the red light as well). Anyway, I awoke from the crash with blood gushing down my face. The woman was able to get out of her car after the accident and did not even come to see if anyone was okay, but was worried about the damage to her car. My boyfriend at the time did not feel hurt so he helped me and I was rushed to the ER with a laceration to the face and a minor concussion. My boyfriend's hip started to hurt on the way to the hospital with me so he got a xray of his hip and nothing was wrong. I am now okay with a very slight scar above my eye. My boyfriend though started to feel back pain about a week later. He went to the doctor and he got some pain meds. When the pain started getting worse, he got 4 MRIs of his spine and neck, which revealed 15-20 herniated disks and fluid in his hip. He is only 25 years old and he can barely get out of bed. He was in school to be a pilot and go to the air national guard, but the doctor told him he will never be able to do that now, so he has to switch careers. You cannot be a pilot or be in the air national guard with a back like his, and he was on his way to doing that it was his dream. He is devastated and in a pretty deep depression now as he also cannot do things he loves like playing golf and being active like he always was. He is in constant agonal pain. He can't stay sitting for long periods of time or standing for long periods of time. He did physical therapy, but it did not work. He is going to a new physical therapist on monday. No one seems to know how to help him and I don't know what to do about this whole situation in terms of suing this woman who ruined his life.

You need to show "serious injury" as that term is defined in the Insurance Law in order to collect pain and suffering from the other driver. You can collect lost wages and for medical bills under the no-fault insurance provisions of you auto coverage. Be sure to file a no-fault claim within 30 days.
