Legal Question in Personal Injury in New York

Atv accident

a friend was driving my ATV with my permission, he injured himself by hitting his chin on the handlebar and knocking out all his teeth. my ins policy does not cover anyone for bodily injury if they are at fault. can this person sue me for the money for his dental bills? i dont own anything, can they garnish wages if he wins?

The issue will not be can he sue. It is can he win. The fact that he took the ATV without permission will help. It is also important that you took steps to avoid allowing the ATV to be taken.

Finally if you do lose, yes a garnishment can be taken against you.

Both of you should look to his own insurance policy and coverage if he is the registrant of a vehicle before ruining your friendship.

If you are sued, your ATV insurance company is still obligated to defend you against any claims against you arising out of the use of the vehicle.
