Who has ownership of a (Xmas) gifted engagement ring after a breakup and wedding cancellation?

A gift is the property of the receiver, however an engagement ring is considered tender for an agreement to marry. Courts of NY have ruled that unless there is a specific gift made, ie the giver has made it clear that the ring is a gift, that the giver, is entitled to receive the ring back even if he broke off the engagement.If you believe you will be in litigation over this issue, you may call our offices and we will talk to you further about representation.
