Legal Question in Personal Injury in New York

how long before a trial date

In Dec. 2004 i fell at a store on ice and recieved a serious break to my ankle, i lost my lifely hood because of this injury, and even after surgery am unable to walk well or work, i hired a lawyer and am still waiting for a trial date as i have been told this is neccessary, i don't understand why it is taking so long, i am about to lose my home to taxes i can not pay,my income went from several thousand a month to 550.00, i was self employed by the state.

i Don't know what county you live in, but where I practice, in NYC and its suburbs, it's not uncommon for case to take up to 7 years to go from initiation to trial. Why don't you ask your attorney for an update on your case?

Broome County does not have a terrible wait from the completion of a case's preparation for trial to the commencement of the trial itself. It may be that there have been delays in completing the pre-trial work. Calling your lawyer and asking the status of the case is the best way to find out what is going on. ask the lawyer what exactly is happening now and what he is waiting for next. if he cannot answer to your satisfaction, tell him that as well. but you need to understand that there are some unavoidable reasons for such delays. and also some tactical reasons that a delay may be equally necessary. There are companies that will, at a ridiculous rate of interest, loan you money for the emergencies you have described but you should avoid them if at all possible. NY has a long wait on its calendars. If you have a serious financial situation, you may petition the court for a trial preference which will speed things up. Good luck.

I am not certain what county you are in, but sometimes, from start to finish, a suit can take years. I know that this is unfortunate but the system often moves slowly.
