Nyc bus accident

i was in an accident on a nyc bus i got hurt but at the time i didn't think it was that bad so i left the scene i ve been in pain since it's been about 2 months anyway i saw the same bus driver a couple of days later and i told her i think i may have her myself in that accident so she gave me the report number and her badge number i for got the date but im really hurt can i still sue even though i left the scene?

When you sue the city you have many additional requirements that must be met. One particularly sensitive to your predicament is that the city typically requires a notice of claim to be filed within 90 days of the accident. Most buses are operated by the NYC Transit Authority, not the City of NY.They are not the same. A written Notice of Claim must be filed within 90 days of the accident. Good luck.

You can still pursue your case. You must file a notice of claim with the bus company (likely the TA or MTA) within 90 days of the accident. As for a lawsuit, the bus company will claim this is an unreported accident because you left. However, it you paid with a metrocard and still have it (or bought the metrocard with a credit card) we can get the records and prove you were on the bus.
