When you sue the city you have many additional requirements that must be met. One particularly sensitive to your predicament is that the city typically requires a notice of claim to be filed within 90 days of the accident. If you can prove that you were on the bus, via a police report, or accident report and you are injured and have had treatment I would consider your case. Most buses are operated by the NYC Transit Authority, not the City of NY.They are not the same. A written Notice of Claim must be filed within 90 days of the accident. Good luck.

You can still pursue your case. You must file a notice of claim with the bus company (likely the TA or MTA) within 90 days of the accident. As for a lawsuit, the bus company will claim this is an unreported accident because you left. However, it you paid with a metrocard and still have it (or bought the metrocard with a credit card) we can get the records and prove you were on the bus.
