Pedestrian hit by a truck in NYC

Hello,

I was hit by a truck while I was trying to get a taxi. I do not remember seeing the truck and do not remember being hit. There is a witness who saw the accident. I am now in hospital with fractured pelvis in twi places, fractured vertibrae, fractured shoulder, punctured bladder, bruised cheak bone, shifted front teeth and bruises on my legs arms and face. I would like to know what the law is regerding personal injury in NY. Can I send all my medical bills to the driver's insurance for payment. What esle am I covered for - lost wages, dental work, physical therapy, travel expenses? I am about to get a lawyer, but I wanted to know what the procedure is and what to expect.

There are several things you need to do. 1) concentrate on getting better; 2) make sure your no-fault application is filed so your medical bills and lost wages get paid. You should file with the insurance company of the car that hit you and your own auto carrier if you or someone you live with has one. If you have your or someone you live with has an auto policy you also need to put them on notice for a potential uninsured/underinsured motorist claim in case the car that hit you has either no insurance or insufficient insurance. If the car that hit you has no insurance and you have no insurance, you have to make an MVAIC (motor vehicle accident indemnification corporation) claim.

There are strict deadlines for these things so you should hire a lawyer right away. The no-fault needs to be filed within 30 days of the accident. You may be approached in the hospital by nurses, etc. offering to get you a lawyer. Don't do it. First it may be illegal for the person to recruit you and you have no idea what you are getting. You poor thing!!!Hit by a truck of all things. You sound pretty beat up and I wish you a speedy recovery.

NY No Fault covers your economic losses up to $50K. (medical, wages, travel, etc). Need to apply w/i 30 days.

However, you seem to have serious injuries that would entitle you to also go beyond No Fault and sue the truck driver/owner/employer for your personal injuries, etc.

Find an attorney with whom you feel comfortable.

You will need to hire an attorney to pursue this matter for you as soon as possible. The attorney you hire should be very experienced in the area of no-fault law as well as motor vehicle accident litigation. After making sure to file for no-fault and putting UM/SUM carriers on notice your attorney will need to determine where the involved policies holders reside. Let your lawyer handle the bills. Do not take anything from the insurance company prior to letting your lawyer handle it. It could severely compromise your rights.
