Legal Question in Personal Injury in New York

Pictures of an accident

My husband was driving I was in the vehicle with my three year old. It was 6-04 we were on the Belt Parkway bumper to bumper traffic. My husband bumped a van in front of us, 7 passengers in their van. 3-4 of the passengers left in an ambulance the rest of them followed. Now we are being sued through the Supreme Court, they said they suffered serious injury and economic loss. We have pictures of this accident and another witness that was in another vehicle. A police report was made they received money from my Insurance company as well. My husband and I are going to answer the summons , my question is what is their chance of winning this suit against us?. We have pictures which clearly show minimal damage to their vehicle and none of us were injured. Also does it help that we have pictures?.

After we respond to the summons what should our next move be?. We never denied that we hit their bumper but at the same time we were not negligent in the operation of our vehicle nor were we reckless. It was honestly just an ACCIDENT.

Immediately turn the Summmons and Complaint over to your insurance company and/or broker that provided you coverage on the date of the accident. Failure to timely do this might result in a denial of coverage.

Do you have insurance? If you do, you should inform your insurance company and they will handle your defense for you. If you do not you should strongly consider hiring an attorney to defend you immediately. The pictures may be helpful to you, but they do not guarantee anything.

Pictures are great! It sounds like you are in good shape.

(1) make sure that your 'answer' says "defendant makes a 'general denial' and denies all statements and claims of the plaintiff."

(2) contact your insurance company. You are already paying for a lawyer through your insurance policy.

(3) do not do more on this case besides the 'general denial'. The rules of evidence and civil procedure are very technical - they each represent a legal specialty and experts work as consultants for other lawyers. Le4t the insurance company lawyers handle it.
