Legal Question in Personal Injury in New York

statute of limitation on personal injury

Aproximately 2 years ago on a drunken night a friend of mine tried to get me to give her a piggy back ride. This was a bad mistake, i fell and knocked out my 2 front teeth, I was 21 at the time. i never persued any legal action, mostly because i was looking to put this behind me. The total dental bills were about 8,000 dollars not to mention the fact that i am permanently damaged... my 2 front teeth are fake and will never look the same as they did! I had a bone graph and had to walk around with partial dentures for almost year.

Am i passed the statute of limitations for personal injury? and do i have a case even though it was unintentional (and i was intoxicated)? - she was the driver, she had a couple of drinks too, but was the driver, i dont know if that matters.

Your statute of limitations is 3 years from the incident. The drunkenness will mitigate your damages, not the liability of your friend.

The Statute of Limitations for normal negligence personal injury actions is 3years from the date of the accident.

What do you mean your friend was the piggy back "driver" ? Is this an auto accident or did you fall off her shoulders? In either evnt you should still have time remaining.
