It depends. Under New York law you cannot sue your employer if you were in the course of your employment. However, there are exceptions to this rule, i.e., if you have what is defined as a grave injury under the Workers Compensation Law.

Additionally, you can have a claim (depending on the facts of your claim) against a third party other than your employer that entitles you to money.
