Legal Question in Personal Injury in New York

Westchester NY

I fell in a public hotel in NY after having several alcoholic beverages. As a result I fell a flight of stairs and broke my hip. I did not fill out a police report or get admitted by ambulance that evening around 12pm. However, the following morning I did go to the hospital and recieved surgery for my fractured hip. Do I have case where I can sue?

You may have a case depending on why you fell and the condition of the staircase. You can sue in the county where you live in NY or the county where the hotel has its primary office. You may also be able to sue in federal court. Feel free to contact me.

Alcohol can make for significant comparative negligence in any personal injury suit, but it doesn't necessarily knock you out of the box. A police report is not required. You don't say what negligence you believe is attributable to the hotel. Was the stairway dark? Something wrong with the steps, handrails, carpet tread, etc. Many questions here. Speak with a lawyer.
