Legal Question in Product Liability in New York
My 86 year old mother pushing her shopping cart in the grocery store when the cart fell over bringing her down with it. It fell on her hand and she needed 5 stitches. She also hit her head on the refrigerated dairy section. No stitches to her head. She went by ambulance to the ER. I did not see her exact cart, but did look at other carts in the store. The cart has a flawed design - very narrow in front and tipped easily. She visited her PCP the next day and he recommended she see a plastic surgeon which she did. Does she have any chance of getting her medical bills paid by the store?
