Legal Question in Real Estate Law in New York

I have an apartment in NYC, where i rent out rooms. The tenants that are renting the room have refused pay and leave. The lease for the apartment is not in my name but in my brother's name and my brother currently lives in Florida. I would like to know how i can evict these people without my brother being present?

Your brother probably has to give you a notarized Power of Attorney authorizing you to sue in his name before you do anything. Check with a local real estate attorney familiar with eviction proceedings to see if anything else may be required.

Attach a copy of the power of attorney to the demand for the rent that must be served before you file suit.
