When dealing with a purchase of a new construction single family residence and their is a dispute. If the purchaser files a ETF-1 claim with the Attorney General's office, does the filing of the claim in itself create an immediate STAY of contractual obligations. Can the Seller still enforce a time of the essence clause to force the Buyer to proceed while an answer has not been returned by the AG. Or, does an article 78 or injunction need to be filed seperately??
