Legal Question in Real Estate Law in New York

Forced to fill propane tank before moving out

I moved into this house 11/00..propane tank was only 1/4 filled. Had it filled. Caretaker of house (owner lives in NYC) told me today that I must have the propane tank completely filled before I leave at the end of the month for the next person who lives here...their daughter. I have no lease, no security deposit was given, either, as I teach with the caretaker's husband. Is there a law that states I must fill this propane tank before moving out? I'd rather not give away $800 if I don't need to.

Re: Forced to fill propane tank before moving out

It depends what the written lease states. If the written lease states that the propane tank must be filled, you must fill the tank. If the lease makes no mention, or if there is no written lease, you have no duty to fill the tank.

There is no law requiring you to fill a gas tank. Since the tank was only 1/4 filled when you moved in it should be 1/4 filled when you move out unless there was a different agreement.
