Legal Question in Real Estate Law in New York

Forms-life lease waiver

I was told that I could do a document waiving a right to life lease. If so , how can I get the form? After it gets signed can I legally do anything with the property, like use it as a rental? Can I dispose or put into storage the things that are my moms in the home now? She is the one with the life lease but is now in a nusing home facility.

Re: Forms-life lease waiver

There is no per se document. I would think that the waiver would be in a deed form with an acknowledgment. To answer your other questions:

Q. After it gets signed can I legally do anything with the property, like use it as a rental?

A. Yes. However, you must comply with local laws concerning rental properties.

Q. Can I dispose or put into storage the things that are my moms in the home now? She is the one with the life lease but is now in a nusing home facility.

A. Yes.

Mike.
