Re: marital property

Hi:

You really have not supplied enough info for me to make a proper determination. NY is an equitable distribution state, and depending on when property was bought and with what funds will help determine who is entitled to what!

You really should speak with an attorney if you are contemplating divorce.

Good Luck

Re: marital property

I assume you mean during the marriage. Property acquired during the marriage by earnings, appreciation and some winnings may be subject to Equitable Distribution. Equitable does not necessarily mean 50-50 though, several factors will be considered to determine what is equitable. One factor will be each spouse's contributions to the acquisition of the property.
