Legal Question in Real Estate Law in New York

Moving in on the weekend

I am moving in to a cooperative apartment. The apartment is paid in full. The only day I could move in on a Saturday, but the board of directors do not like people moving on the weekends. Can they fine me for moving in on Saturday? There is nothing in the contract and I will not disturb anyone.

Even though your contract maybe silent on the issue. The Co-ops bylaws may have restrictions on moving days and fines associated with the violation of those restrictions. Since your contract will in all likelihood incorporate those bylaws you would be subject to the restrictions listed in them. I would recommend reading those bylaws carefully not just for possible moving day restrictions but for other rules and restrictions that may be applicable.

Check into what the condo by-laws or rules state. Some condos have rules against moving on specific days and may have a fine structure in place.
