Legal Question in Real Estate Law in New York

Does NY state RE law dictate that as of closing date, seller needs to be vacated out of home, or can they stay there beyond closing without doing a rent back option? Is there a post closing grace period for moving?

NY law does not dictate, but the Contract of Sale usually includes a clause that the purchaser occupies the premises after closing. Seller can prepare a post occupancy agreement that both parties would have to sign in order to allow the seller to remain in possession of the premises for some period after closing. You should discuss this with your attorney in order to insure you are properly protected.
