Legal Question in Real Estate Law in New York

payment for services not requested

When the family home was sold in 2003 I had to give my power of attorney to a lawyer hired by my siblings. Instead of returning it to me as promised he said he lost it. Then the document proving the mortgage extinguishment disappeared and the bank held a down payment of $14,750. A year later I requested information from the lawyer and was told he was no longer involved as my sister was handling it. I was informed in 2008 via email first by my sister, then the lawyer the money was available and needed my mailing address and permission to be released .

I sent my mailing address but no authorization. No papers arrived so I sent a letter. The lawyer replied a check was sent DHL but returned as no one was home and I hadn�t given a phone number; which wasn�t requested! I mentioned I hadn�t given permission to distribute the money and wire transfer is the best way to send money. He replied it was impossible and was going to bill me for services I hadn�t requested! I don�t know who has the money and haven�t asked as he may request payment again. Am I obliged to pay?

How much money are you out? This has been going on for five (5) years. Don't you think that you should have received it by this time.
