Purchase of Coop

I put a down payment of 17000 for a coop. The coop denied me and its been two months and the attorney has not given me my deposit in spite of several calls. How do I take the lawyer to court for my refund. And how long does it normally take to receive the deposit.

If the attorney is holding your money in his escrow account, he has to return it right away upon your request. Send him a letter by regular and certified mail advising him that if the funds are not returned to you within 7 days, you will be filing a grievance with the BAR. If you do not get a response, call NY State Bar Association and they will give you further instructions.
