Legal Question in Real Estate Law in New York

Question:

I was in a friends car when I become sick and vomited on myself and the interior of the car. I gave the friend $60 to get the car detailed and the seat clean. The "friend" said that he wasn't able to get the seat properly cleaned and the smell removed from the car after the cleaning and wants a new seat for $1200. I said absolutely not and that I want to see the car for myself. He keeps coming up with excuses not to let me see the car.

I went to another detail shop and they said that they can steam clean the leather seat for $40 and the smell will be removed as this is a common clean job (car sickness, and children constantly vomit in cars). The friend wont meet me at the place and just wants the money. Now, i was trying to do the right thing as a person to help clean his car, but do I really owe him anything? I don't think so. I feel like he is just trying to take advantage of the situation to earn some money.

My real question is do I owe him anything? Can he sue me for the cost of the new seat although i was a guest in his car? I really think there is no stain or smell problem.

A. In my opinion, no.

Q. Can he sue me for the cost of the new seat although i was a guest in his car?

A. An individual may sue anyone for anything. That does not mean he will win.
