Legal Question in Real Estate Law in New York

real property incorporation

I am a real estate investor who owns properties in several states. At this point, I am concerned about asset protection and therefore am likely going to pursue incorporation of my properties. Is there a law stating that the property must be incorporated in the state where the property is located?

No, you are free to incorporate your company in any state you wish but you may have to "qualify" the company in the states where it owns property by filing a Certificate of Authority. This may affect corporate taxes and make it easier for local parties to sue your corporation. Contact a corporate attorney for advice on how to structure your real estate investments.
