Legal Question in Real Estate Law in New York

Will

In my will, Is it possible to leave my home, which is in both my name and my husbands name, to my daughter, if i pass away before my husband does? I have power of attorney over my husband. i would like to state that in the event of my passing she is to recieve the home, even if he is still living. can this be done?

Re: Will

If you own the property with "right of survivorship," which is most likely, you cannot transfer your interest by Will.
