Legal Question in Tax Law in New York

Can my same-sex partner be claimed as my dependent?

My same-sex partner and I are expecting our first child in April 2009. She is going to stop working after the baby is born. Will I be able to claim her as my dependent on my 2009 tax return, even though we are not legally married?

If you legally adopt the baby you will be entitled to claim an exemption in 2009 if you provide more than one half of its support.
